PhoenixLMS is operated by Tahmeed Nabi, trading under the Australian Business Number (ABN) 28 519 020 319, a sole trader business based in New South Wales (NSW), Australia. By accessing and using our website at https://www.phoenixlms.com ("Website") and any services provided by PhoenixLMS ("Services"), you agree to be bound by the following terms and conditions ("Terms").

1. Acceptance of Terms

  1. By using PhoenixLMS, you agree to these Terms and Conditions in full. If you disagree with any part of these Terms, you must not use our Website or Services.

2. Subscription Plans and Payment

  1. PhoenixLMS offers various tiered subscription plans charged on a monthly basis. Details of the subscription plans and the services included are available on our Website.
  2. Payments are processed through Stripe. By subscribing to our Services, you agree to Stripe's terms and conditions.
  3. Subscription fees are billed in advance on a monthly basis and are non-refundable, except as required by law or as explicitly stated in these Terms.
  4. When changing subscription plans, you will be immediately charged for the new plan rate at the time of change.
  5. If a free trial is offered and you do not cancel the trial before the end of the trial period, you will be charged the full subscription fee for the next billing cycle.

3. Use of Services

  1. Clients are able to send SMS messages and customize email templates for communication with their customers as part of our Services.
  2. You agree to use our Services in compliance with all applicable laws, including but not limited to privacy and data protection laws.

4. Cancellation and Termination

  1. You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing cycle, and you will have access to the Service until the end of the billing cycle.
  2. PhoenixLMS reserves the right to suspend or terminate your account and refuse any current or future use of the Service for any reason at our sole discretion.

5. Modifications to Terms and Services

  1. PhoenixLMS reserves the right to modify these Terms or the Services at any time. We will notify you of any changes by posting the new Terms on the Website or through other communication channels. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.

6. Governing Law

  1. These Terms shall be governed by and construed in accordance with the laws of New South Wales (NSW), Australia. Any disputes related to these Terms will be subject to the exclusive jurisdiction of the courts of NSW.
